Terms & Conditions

LIVEMOMENTO PHOTOGRAPHY represents one facet of the business services offered by the duly registered entity known as HAMSHA STUDIO.

PAYMENT & BOOKING: Upon payment of the deposit or booking with us, customers hereby agree to abide by the following terms and conditions:
1. Payment Method: 
a) To commence or conclude a photography session, payment for services must be settled in full either before the session commences or upon its completion.
b) Payment options include cash, cheque, credit card, debit card, bank transfer, or online banking, with all payments made payable to HAMSHA STUDIO, Maybank Account No: 562393512426.

2. Mode of payment:
a) A booking fee of RM50 for studio sessions or RM200 for event sessions, or an amount mutually agreed upon by both parties for confirming the booking date, is required. Failure to remit this fee within the stipulated time frame will result in the booking being considered canceled, with no refund issued.
b) For booking confirmation (3-4 weeks prior to the event or photo session date), a payment of any 30-50% of the total cost is required.
c) The remaining balance of the total payment must be settled on or no later than one week before the event or photo session date.

3. Cancellation:
The client acknowledges that in the event of booking cancellation, all booking fees will be deemed non-refundable.

4. Outstation Fee:
A minimum fee of RM100 may be charged (if applicable) for outstation services (outside of Malacca), excluding transportation, travel expenses, and lodging for the assigned photographer(s).

5. Other Fees:
a) Mileage charges apply as follows (if applicable):
• For the first 100km: RM0.50 per km
• For the second 100km: RM0.45 per km
• For the third 100km: RM0.40 per km
• For the fourth 100km: RM0.35 per km
• For the fifth 100km: RM0.30 per km
b) Clients may be liable for toll and parking fees (machine parking).
c) HAMSHA STUDIO reserves the right to levy additional charges if estimated costs exceed actual expenses incurred.

6. Quotation:
a) Quotations are valid for 30 days only, after which unconfirmed clients must re-submit their inquiries.
b) Changes to confirmed bookings may result in adjustments to the booking price.

7. Booking:
a) Booking constitutes a mutual agreement, with booking fees being mandatory. Verbal bookings will not be accepted.
b) Priority for bookings will be determined on a first-come, first-served basis.
c) Failure to adhere to payment requirements (deposits and booking confirmation fees) within the specified timeframe may result in the cancellation of bookings by HAMSHA STUDIO, with all booking fees deemed non-refundable.

8. NATURE OF EVENT or CANDID PHOTOGRAPHY
a) Nature of Photography:
Our photography style primarily focuses on capturing candid moments as they naturally unfold during the event. These moments may not always portray individuals in their best or most composed state due to the fast-paced nature of event photography.
b) Photographer’s Discretion:
Our photographers exercise their professional judgment in selecting and capturing moments during the event. While we aim to capture the essence and spirit of the occasion, we cannot guarantee that every photo will meet individual preferences or expectations.
c) Subject Consent:
By participating in the event, attendees acknowledge and consent to being photographed by our team. While we make efforts to respect privacy and capture images respectfully, attendees understand that they may appear in candid photos taken during the event.

9. END PRODUCTS
a) Printed Album, Printed Photo, or Finalized Video:
The culmination of our photography services results in meticulously curated end products, including printed albums, individual printed photos, or finalized videos. Clients can anticipate the delivery of these items within 3 months from the event date, final payment, or upon completion of the selection process for finalized photos. Our commitment to delivering exceptional quality extends to these end products, ensuring that they encapsulate the essence and beauty of the captured moments.
b) Edited Photo:
We pride ourselves on our editing prowess, meticulously refining each photo to achieve the desired aesthetic and narrative. Edited photos are estimated to be available for collection or download within 7-14 working days. However, in cases where photos necessitate complex editing or during peak seasons characterized by high demand, a grace period of 14-30 working days or potentially longer may be required. This extended timeframe ensures that each photo receives the attention to detail it deserves, resulting in a polished and stunning final product.
c) Peak Season Grace Period:
During peak seasons, such as wedding seasons or festive periods, the demand for our services may surge, necessitating additional time to fulfill orders. As such, the delivery of end products may be subject to an extended grace period of up to 6 months from the date of service completion. While we strive to adhere to our standard timelines, this grace period allows us to manage workload effectively and uphold our commitment to delivering excellence, even amidst heightened demand.

10. Distribution of Goods
In adherence to the stipulations herein, HAMSHA STUDIO retains the prerogative to delay the distribution of merchandise, encompassing albums, videos, or any final product, until such time as all outstanding payments have been duly settled, ensuring compliance with the contractual obligations.

11. Client Softcopy and Raw Material
Provision of unedited material in softcopy format to the client constitutes an integral facet of our services. The client bears the onus of meticulously examining the softcopy of images tendered within a grace period of three days subsequent to delivery. Moreover, raw softcopies shall be made accessible for collection or download within a span of seven working days following the conclusion of the photo session.

12. Album Design and Selection
Concerning the design of photo albums, HAMSHA STUDIO reserves absolute autonomy to orchestrate the layout in a manner deemed most suitable. Consequently, clients are precluded from articulating personalized design requests, as the designer retains discretionary authority to deviate from such directives. Moreover, clients intending to engage in photo selection must first fulfill the prerequisite of full settlement, after which the entire gamut of photos will be provided through suitable means for their perusal and selection within a prescribed week. It is imperative to note that the final curation for album inclusion rests solely within the purview of our Editor, who exercises discernment in selecting the optimal photos for publication. Additionally, supplementary work necessitating new designs or enhanced editing shall incur an incremental charge of RM 500 per album. Clients harboring an exigency for expeditious acquisition of all softcopies within a time frame as short as one to two weeks post-wedding must effectuate full settlement promptly.

13. Retrieval Procedure
The retrieval of photo albums or videos can be effected at HAMSHA STUDIO premises, albeit clients opting for direct delivery will be subject to supplementary courier charges.

14. Download Link Validity
Any download links furnished remain valid for a duration of 30 days, subject to HAMSHA STUDIO‘s discretion to extend or curtail the validity period as exigencies dictate. Clients are advised to promptly download all images within this stipulated timeframe to avert any potential inconvenience.

15. Timeframe for Album Collection
It is incumbent upon clients to ensure collection of albums within a six-month window, beyond which HAMSHA STUDIO absolves itself of any liability pertaining to the material package.

EVENTS
16. Contingency Measures and Limit of Liability
In unforeseen circumstances such as photographer unavailability due to illness, accidents, or other incapacitating events, HAMSHA STUDIO reserves the right to substitute or replace the assigned photographer(s) to ensure continuity of service provision. Additionally, the doctrine of force majeure safeguards HAMSHA STUDIO against liabilities arising from impediments beyond reasonable control, encompassing but not limited to war, natural disasters, labor shortages, or governmental restrictions. Moreover, in the event of unexpected occurrences such as accidents during transit to the venue, HAMSHA STUDIO absolves itself from any ensuing responsibility.

17. Duration and Additional Coverage
The average duration of event coverage typically spans between four to five hours, unless otherwise stipulated in our event packages. Should the client necessitate extended coverage beyond the stipulated timeframe, additional fees will be levied accordingly. Furthermore, engagement of additional photographers to enhance coverage incurs supplemental charges, which are exclusive of outstation work expenses. Collaboration between both parties is imperative to optimize outcomes for the assignment.

18. Assurance of Outcome and Client Cooperation
HAMSHA STUDIO disclaims liability for any perceived shortfall in the outcome of the assignment attributable to failure of client cooperation during photography sessions or non-disclosure of pertinent details prior to the commencement of the session. Particularly for VIP coverage, the client is required to designate at least one individual to facilitate the photographer’s access and provide guidance on protocol. This proactive measure ensures seamless execution of the photography session.

19. Photography and Videography Personnel
All photographic and videographic endeavors are undertaken by personnel employed directly by HAMSHA STUDIO or LIVEMOMENTO PHOTOGRAPHY, adhering to rigorous standards of professionalism and expertise. The assurance of quality and reliability in service delivery is paramount in all our endeavors.

20. Copyright and Usage
In accordance with copyright laws and intellectual property rights, all photographs captured during events are vested as the intellectual property of HAMSHA STUDIO. The client is granted limited rights for personal use, with stringent prohibitions against dissemination to third parties for reproduction or publication without explicit written consent. Furthermore, HAMSHA STUDIO reserves the prerogative to utilize event images for promotional and commercial purposes, subject to mutual agreement.

21. Outdoor Session Logistics
Outdoor sessions, provided as a complimentary service post-event under specific packages, are subject to weather conditions. In the unfortunate event of inclement weather or unavoidable circumstances, outdoor sessions stand automatically canceled. The designated location for outdoor sessions must be within a 15-minute travel radius or approximately 20 kilometers from the event venue, with the client responsible for their transportation arrangements. Clients are encouraged to suggest preferred outdoor shooting locales, facilitating customization and personalization of the photography experience.

22. Disputes
In the event of disputes arising during the course of service, HAMSHA STUDIO reserves the right to withdraw from the assignment, retaining any non-refundable deposits. Such disputes may include conflicts between multiple photography teams covering the same event or circumstances where continued participation is not deemed beneficial to the quality of service provided.

23. Photography Official
Clients acknowledge and agree that only HAMSHA STUDIO is authorized to provide photography services for the designated event. While family and friends may engage in photography for personal, non-commercial purposes, they must not interfere with the duties of our professional photographers. If, in the opinion of the assigned photographer, such individuals hinder the photography process, the client is responsible for ensuring that they cease their activities.

24. Online Viewing
While HAMSHA STUDIO endeavors to provide online viewing options for event photos, it is important to note that not all images captured during the event will be made available for online viewing. The selection process is guided by our professional judgment, aiming to showcase the highlights and essence of the event. Clients may inquire directly for specific image requests that may not be available online.

25. Client Responsibility
Clients are responsible for providing adequate food and lodging arrangements, where necessary, for the assigned photographers during the event. Ensuring the comfort and well-being of our team members contributes to the smooth execution of photography services, allowing us to focus on capturing the memorable moments of the occasion.

26. Image Ownership
Throughout the duration of the event, all images captured remain the property of HAMSHA STUDIO. Clients are prohibited from deleting or tampering with images stored in the camera during the course of photography services. This policy ensures the integrity and security of the images captured, preserving the professional standards upheld by our studio.

27. Specific Requests
To ensure that client preferences and expectations are met, clients are encouraged to communicate any specific requests or preferences regarding photography coverage before the commencement of the event. This includes highlighting particular scenes or activities that they wish to be captured or any scenes they prefer not to be photographed. Such information allows our team to tailor the photography service to the client’s vision and requirements effectively.

28. Data Retention
For data management purposes, HAMSHA STUDIO may retain related materials, including digital files and raw footage, for a period of up to 3 months after the printing of the event album. This retention period allows for any potential post-production requirements and serves as a safeguard against unforeseen circumstances that may necessitate accessing the original data.

29. Pre/Post Wedding Sessions
Clients are offered the opportunity to participate in pre and post-wedding photography sessions as part of our service offerings. These sessions are complementary and serve as an additional opportunity to capture cherished moments before or after the wedding event. While these sessions are typically non-exchangeable, exceptions may be considered based on mutual agreement between the client and HAMSHA STUDIO.

OTHERS
30. Acceptance
By engaging the services of HAMSHA STUDIO, clients signify their acceptance and agreement to abide by all terms and conditions outlined in this document. Acceptance of our service packages signifies acknowledgment of the terms and conditions set forth in the contract of service, establishing a mutual understanding between both parties.

31. Modus Operandi
Clients are expected to acknowledge and accept the operational style and procedures implemented by HAMSHA STUDIO. This includes recognizing the professional standards upheld by our team in delivering quality goods and services, encompassing aspects such as workmanship, pricing, and overall service delivery.

32. Updates
To ensure the relevance and effectiveness of our agreements, the client agreement may be subject to periodic updates and revisions. These updates are intended to accommodate the evolving needs and preferences of both clients and HAMSHA STUDIO, fostering a collaborative and mutually beneficial relationship.

33. Artwork Sale
Clients are reminded that the sale of artwork, including photographs, videos, and related materials, is conducted exclusively by HAMSHA STUDIO. Clients are prohibited from engaging in the sale or distribution of these materials without prior written consent from HAMSHA STUDIO. This policy safeguards the intellectual property rights and commercial interests of our studio.

34. Communication
To ensure effective communication and coordination, clients are required to transmit all important information, including event dates, contact numbers, and other relevant details, via email. Communication through email facilitates documentation and ensures that all pertinent information is accurately recorded and accessible for reference throughout the service engagement.

35. Consultations
Pre-event consultations with photographers or cinematographers are conducted exclusively at HAMSHA STUDIO premises. Clients are encouraged to schedule appointments to discuss event details, preferences, and any specific requirements with our team members. This facilitates effective planning and ensures that client expectations are adequately addressed and incorporated into the photography service.

36. Privacy
Clients are expected to respect the privacy rights maintained by HAMSHA STUDIO, particularly concerning the layout and content of event albums. Unauthorized reproduction, publication, or distribution of any part of the album content, including images and videos, through creative expressions such as blogs, websites, or social media platforms, is strictly prohibited without prior consent from the studio.

37. Cancellations
In rare instances where HAMSHA STUDIO finds it necessary to cancel a customer booking due to unforeseen circumstances, such as equipment failure or staffing issues, clients can expect a 100% refund of their deposit. This policy reflects our commitment to maintaining transparency and fairness in our business practices.

38. Prayer
To accommodate the religious obligations of our team members, photographers and cinematographers on duty are granted exemptions during prayer times. This ensures that our team members can fulfill their religious duties while continuing to provide uninterrupted service to our clients.

39. Makeup Sessions
Clients are encouraged to inform HAMSHA STUDIO in advance if any restrictions or preferences regarding the capture of makeup sessions exist. This allows our team to make necessary arrangements and adjustments to ensure that client preferences are respected and accommodated during the photography service.

40. Agreement
By affixing their signature to this agreement, clients acknowledge that they have read, understood, and accepted all the terms and conditions outlined herein. Furthermore, clients confirm that they have received all pages of the agreement document, indicating their complete understanding and acceptance of the terms contained within.
